1. Introduction

Welcome to PIXELWEB. These Terms of Service ("Terms") govern your use of our website and our web design, development, and digital marketing services. By accessing our website or engaging our services, you agree to be bound by these Terms, which are governed by the laws of New Zealand.

2. Services and Scope

We provide digital services including but not limited to web design, application development, and marketing.

  • All projects will have a defined scope of work agreed upon prior to commencement.
  • Any additional features, revisions, or requests outside the agreed scope will be subject to additional quotation and approval.

3. Payment Terms

Payment schedules will be outlined in your project proposal. Standard terms include:

  • A non-refundable deposit is required before any design or development work begins.
  • The final balance is due prior to the website or application going live.
  • All prices are quoted in New Zealand Dollars (NZD) and are exclusive of GST unless otherwise stated.

4. Client Responsibilities

To ensure timely delivery of your project, you agree to provide complete and accurate information, copy, images, and feedback when requested. Delays in receiving necessary materials may result in adjustments to the project timeline.

5. Intellectual Property

Upon receipt of full payment, the intellectual property rights to the final website design and custom code developed by us will transfer to you. We reserve the right to display the completed work in our portfolio and marketing materials. You guarantee that any supplied text, graphics, photos, or designs are owned by you or you have permission to use them.

6. Warranties and Liability

In accordance with New Zealand law, including the Consumer Guarantees Act 1993 (where applicable):

  • We test our work extensively, but we do not guarantee that functions contained in any website or application will always be error-free.
  • We are not liable to you or any third party for damages, including lost profits, lost savings or other incidental, consequential or special damages.

7. Termination

Either party may terminate the agreement upon written notice if the other party breaches these Terms. You may cancel the project at any stage; however, deposits are non-refundable and you will be invoiced for any work completed up to the cancellation date.

8. Governing Law

These Terms of Service are governed by the laws of New Zealand. Any disputes arising in connection with these Terms shall be subject to the exclusive jurisdiction of the New Zealand courts.
